Limited Warranty

 

  1. Where NaturaStone LCS the product has been used, fabricated and installed by a distributor who has obtained express approval to fabricate and install the NaturaStone LCS material.
  2. NaturaStone Australia Pty Ltd hereby warrants the NaturaStone material is free from defects for a period of 12 years from the date of purchase.
  3. NaturaStone Australia Pty Ltd undertakes at is sole discretion to repair or re-manufacture or credit the NaturaStone LCS product which with proper care is deemed to be faulty.
  4. NaturaStone Australia Pty Ltd limits its extent of warranty to the end product in the form as supplied by NaturaStone Australia Pty Ltd.
  5. (i) These terms and conditions are not intended to and do not affect your statutory rights. (ii) The limitations on this Warranty which is set out in this document are not intended and does not exclude or limit the application of the mandatory conditions and warranties implied under Australian Consumer Law, the Competition and Consumer Act 2010 or any other provision in that Act, the Consumer Guarantees Act, or any other equivalent or corresponding legislation in the relevant jurisdiction of any State or Territory where to do so would: (a) contravene the law of the relevant jurisdiction; (b) cause any part of the warranty to be void. (iii) Subject to this paragraph 5 (ii), NaturaStone Australia Pty Ltd excludes consequential loss of any kind (including, without limitation, loss of use of the Product) and (other than expressly provided for in these terms and conditions) all terms, conditions and warranties implied by custom, the general law or statute. (iv) Subject to paragraph 5 (ii), NaturaStone Australia Pty Ltd is liable to you for a breach of any express term, condition or warranty is limited at the option of NaturaStone Australia Pty Ltd to replacing the NaturaStone product as per clause 4.
  6. NaturaStone Australia Pty Ltd shall not be responsible for any promises, warranties or representations unless the same are given by the company in writing.
  7. This warranty extends to the original purchaser and is not transferable.
  8. Without Prejudice, NaturaStone Australia Pty Ltd may, in its absolute sole discretion, as a gesture of goodwill, supply replacement product free of charge, to any accredited fabricator that you nominate, to assist in resolving any disputes. This goodwill gesture and offer will be determined after an assessment on case by case basis by NaturaStone Australia Pty Ltd at its own sole discretion only. This offer is limited only to the supply of “free uncut slabs to the quantity used for the installation” and does not include transportation, crating, fabrication, installation or any other associated charges for trades, removal of existing product, nor do we take any responsibility for any damage that may be caused by other parties in the process of replacing the Product. This offer cannot be exchanged or converted for cash compensation, and is limited to slabs only. In so far as this goodwill gesture is a voluntary offer, we reserve the right to withdraw this offer at any time without notice. This is a onetime offer per site. The product must be collected within 30 days from when it is made available or this offer will be withdrawn. This offer may be made available for the original purchaser of the product and is not valid for subsequent owners. This offer, it does not confer any obligation to any third party to provide any services or costs whatsoever, nor does it imply that there is any condition or liability for any third party because we have provided the product free of charge.
  9. This warranty is also subject to exclusions as listed.
  10. This warranty only becomes valid when NaturaStone Australia Pty Ltd has been paid in full for the product supplied including any other NaturaStone LCS product supplied and any outstanding accounts are brought up to date and paid in full.
  11. To obtain service contact your supplier and provide written notice of a warranty claim within 28 days of any alleged defect or alleged failure of the material and provide a copy of the invoices and receipts of purchase including relevant details including fabricator and installer information and installed site and customer details and  any other information as requested by NaturaStone Australia Pty Ltd. Failure to provide written notice within 28 days of any alleged defect or alleged failure of the material along with the relevant information shall render the warranty null and void.


 

EXCLUSIONS - Subject to this paragraph 5 (ii):

 

  1. This warranty excludes and does not cover damage or loss due to:
  2. Any defect in, or damage to, the NaturaStone LCS material which has arisen from any work done by any person other than NaturaStone Australia Pty Ltd.
  3. The warranty covers any defects in the manufacture of the original slabs. The subsequent fabrication, installation and workmanship is not covered under this warranty
  4. Normal wear and tear.
  5. Improper installation. The material must be installed by an approved and accredited fabricator and installer.
  6. Improper maintenance. The material must be cleaned and maintained in accordance with the manufacturers recommendations.
  7. Misuse or abuse.
  8. Failure of any joining compounds, caulk, adhesives, filled joins filled seams, substrate adhesives or joining accessories, including damage or cracking caused to the surrounding surface propagating from any of the above.
  9. Excessive heat damage caused by placing hot objects directly on to the surface of the product or exposure to open flame or excessive radiant heat or undue thermal shock.
  10. Damage caused by excessive impact such as objects dropped, thrown or bumps or excessive loads placed on the surface or edges.
  11. Exposure to strong chemicals such as solvents and cleaning agent which have high alkaline/pH levels.
  12. Damage caused by cutting or chopping on or abrading the surface.
  13. Damage including cracking or warping due to either damp, damaged, inadequate, unfastened, unsupported, unbalanced and unsealed substrates, expansion and contraction of substrates and differential expansion and contraction of the substrates and the product, improper fabrication, handling, transporting, storing and handling.
  14. Cracks are generally not a fault of the product; cracking usually results from undue and excessive mechanical stress externally induced on the product after installation. Settlement, movement, excessive weight, heat, and inadequate support damp substrates are part of the likely externally causes. Cracks emanating from cook-top cut-outs, sink cutouts, “L” shape cut-outs, internal and external corners and returns are generally not a fault of the product.
  15. Chipping on the edge or surface.
  16. Product which has be removed and relocated.
  17. Damage due to structural or cabinetry support changes due to movements in the cabinets or substrates.
  18. Used in outdoor applications.
  19. Any variations in colour, or gloss between slabs.
  20. Performance of non-quartz aggregates such as pearl aggregates which are natural mother of pearl which can be affected by acids such as vinegar, lemon juice or similar, mirror aggregates which are recycled mirror particles which contain a synthetic coating on one side of the glass to form the mirror and the coating may be affected by strong acids, solvents and cleaners, etc.
  21. Use as splashbacks not in accordance with local gas and fuel specifications, including splashbacks without clearance between the counter surface.
  22. Variations in shading, colour, aggregate size, distribution, agglomeration of particulate and patterning can occur, variations in appearance caused by artificial, reflected or natural light.
  23. Any imperfections or irregularities not brought to the supplier prior to cutting and or fabrication and installation of the product.
